Terms of Use
The terms on which you may use Audora.
1. Acceptance
These Terms of Use are an agreement between you and Antilver Systems Private Limited ("Antilver", "we", "us") covering your use of the Audora application ("Audora", "the app"). By installing or using Audora, you accept these terms. If you do not accept them, do not install or use the app.
Your use of Audora is also covered by our Privacy Policy, and by the terms of the store you obtained the app from.
2. Licence to use Audora
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Audora on devices you own or control, for your own personal, non-commercial use.
Audora is licensed to you, not sold. We retain all rights in the app, its name, and its design that are not expressly granted to you here.
You may not: copy, redistribute or resell the app; reverse-engineer, decompile or disassemble it except to the extent that applicable law expressly permits despite this restriction; remove or alter any notices in it; or use its name or branding to imply an association with Antilver that does not exist.
3. Your media and your responsibility for it
Audora plays files that are already on your device. It does not supply, host, stream, sell, index or distribute any media content, and it does not help you find or download any.
The files you play through Audora are yours to account for. You are responsible for ensuring that you have the legal right to possess and play each file you open in Audora, and for complying with the copyright and other laws that apply to you.
We have no visibility into what you play — as explained in the Privacy Policy, information about your library stays on your device. We therefore cannot and do not monitor, review, approve or endorse any content you use with the app, and we accept no responsibility for it.
4. Acceptable use
You agree not to use Audora:
- to infringe copyright or any other right of another person;
- in any way that breaks a law that applies to you;
- to attempt to gain unauthorised access to any system, or to interfere with the app's or any service's normal operation;
- to attempt to defeat, disable or circumvent any security, permission or access control in the app or on your device.
5. Availability and changes
We may update, change or discontinue Audora, or any of its features, at any time. We may also stop supporting particular Android versions or devices. Updates are distributed through the store you installed the app from, and some changes may require you to install an update to keep using the app.
6. No warranty
Audora is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, to the fullest extent permitted by law. This includes, without limitation, any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the app will be uninterrupted or error-free, that it will work with every file, format or device, or that defects will be corrected. Playback depends on your device's own hardware and media decoders, which vary between devices and are outside our control.
You are responsible for your own data. Audora does not delete or modify your media files in normal use, but you should keep your own backups of anything you value.
7. Limitation of liability
To the fullest extent permitted by law, Antilver will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, loss of profits, loss of use, or loss of goodwill, arising out of or in connection with your use of or inability to use Audora, however caused and on any theory of liability.
To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with Audora or these terms will not exceed the greater of the amount you actually paid us for the app, if any, or INR 1,000.
Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
8. Termination
You may end this agreement at any time by uninstalling Audora. We may suspend or end your licence if you materially breach these terms. Sections 3, 6, 7 and 9 survive the end of this agreement.
9. Governing law
These terms are governed by the laws of India. The courts at Bengaluru, Karnataka, India have exclusive jurisdiction over any dispute arising out of or relating to these terms or to Audora, subject to any mandatory right you may have under the consumer-protection law of the country you live in.
10. Changes to these terms
We may update these terms. When we do, the version number and date at the top of this page will change, and the updated terms take effect when published here. If you continue using Audora after that, you accept the updated terms. If you do not accept them, uninstall the app.
